On Monday, the U.S. Supreme Court dismissed an effort by Missouri’s Republican attorney general to delay the sentencing of former President Donald Trump in his New York criminal hush money case.

The Supreme Court refused to hear Missouri’s lawsuit against New York.

The brief, unsigned order noted that Justices Alito and Thomas would have considered the complaint.

“Missouri’s motion for leave to file a bill of complaint is denied, and its motion for preliminary relief or a stay is dismissed as moot,” the order stated. “Justice Thomas and Justice Alito would grant the motion for leave to file the bill of complaint but would not grant other relief.”

Trump was convicted in May on 34 felony counts of falsifying business records tied to a 2016 hush money payment to adult film actress Stormy Daniels to boost his 2016 presidential campaign. He plans to appeal the verdict.

The former president’s sentencing is set for 18 September.

Judge Merchan recently postponed Trump’s sentencing from the initial 11 July date to consider Trump’s request to overturn his conviction based on a recent Supreme Court ruling on presidential immunity.
