The Thaiger Content and Advertising Guidelines

These guidelines establish the scope, content, and format of all advertisements on The Thaiger’s platform- whether Advertorials, Videos, or other ad formats. Our goal is to maintain ethical standards and strictly comply with Thai regulations.

1. Legal and Licensing Requirements

1.1 Products Requiring Licenses or Registration

  • Advertisers must provide valid proof of licensing or registration issued by the relevant Thai government agencies if their product or service is legally regulated. Examples include:
    • Medicines, pharmaceuticals, chemicals, or cosmetics (required FDA or equivalent approval)
    • Certain electronics or electrical devices require TISI certification or relevant permits.
    • Alcoholic beverages (required production/import/distribution license as mandated by Thai law)
  • All ad content for such products must be approved by The Thaiger’s Editorial team before publication.

1.2 Product/Service Information Disclosure

  • Advertisers must provide the price (in Arabic numerals) along with any other costs (e.g., shipping fees, extra service charges) in a truthful and transparent manner to the team for content production.
  • Product details (e.g., dimensions, weight, components) and usage limitations or warnings (if any) must be stated in Thai, with the option to include other languages as well.
  • Pricing must match the actual selling price; instructing customers to “inbox for price” instead of publicly displaying it is prohibited under Thai consumer protection laws.

2. Prohibited Content

The following content types are strictly prohibited from being advertised, sold, or promoted on The Thaiger’s platform in any format:

2.1 Illegal or Unlicensed Products/Services

  • Gambling platforms, casinos, and betting services
  • Illegal or unlicensed drugs, including unregistered herbal or dietary supplements
  • Counterfeit, pirated, or infringing goods (e.g., pirated software, fake brand products)

2.2 Alcohol Advertising

  • Displaying alcohol products or logos directly in ads (e.g. Featured image, thumbnail)
  • Content suggesting that drinking alcohol is healthy or glamorous
  • Influencer campaigns that directly endorse alcohol brands

2.3 Tobacco and Vaping Products

  • Cigarettes, cigars, vaping devices, or related tobacco products
  • Ads promoting the act of smoking or vaping in any form

2.4 Pornography and Adult Content

  • Explicit or pornographic material
  • Advertisements for adult services, pornographic platforms, or erotic content

2.5 False or Misleading Claims

  • Health or beauty products claiming unverifiable, exaggerated, or “miracle cure” effects without legitimate scientific evidence or licensing
  • Pyramid schemes, get-rich-quick scams, or fraudulent investment opportunities

2.6 Political or Sensitive Content

  • Content that defames or insults the Thai monarchy (Lèse-Majesté), or otherwise violates national security laws
  • Political content inciting hatred, social unrest, or hate speech

2.7 Culturally Insensitive Content

  • Disrespecting religion, using religious symbols inappropriately
  • Any reference or action that dishonours monks or sacred entities

2.8 Other Content Violating Thai Laws

  • Anything that breaches Thai laws, such as the Consumer Protection Act, Computer Crime Act, Criminal Code, etc., or that might cause harm to society or the public

3. Allowed Content with Restrictions

3.1 Healthcare and Wellness

  • Ads for healthcare products or services must:
    • Avoid unverified medical claims
    • Display clear disclaimers such as: “Results may vary by individual” or “This product is not intended to diagnose, treat, or prevent disease” (for supplements)
    • Cite credible sources or expert testimonials if referencing scientific studies or medical endorsements

3.2 Financial Services

  • Ads related to investments, insurance, or financial services must:
    • Avoid promises of guaranteed returns (e.g., “100% guaranteed profit”)
    • Include disclaimers about risks and comply with relevant financial regulations

3.3 Alcohol-Related Campaigns

  • Campaigns that indirectly involve alcoholic beverages (e.g., sponsoring events) may be permitted, but must not:
    • Display the actual products, glasses, or logos
    • Glamorise alcohol consumption or promote it as healthy

3.4 Events and Tourism

  • Advertorials or ads for events, hotels, or tourist attractions must:
    • Comply with local laws and regulations
    • Avoid promoting unsafe or illegal activities (e.g., excessive or reckless partying)

3.5 Sponsored Articles and Videos

  • Sponsored content must:
    • Be clearly labelled as “Sponsored”, “Advertorial” or “Press Release” (if applicable).
    • Follow The Thaiger’s editorial tone and style without misleading the audience into thinking it is purely editorial content

4. Social Media Advertising Guidelines

When running ads on Google Ads (including YouTube) or Meta platforms (Facebook, Instagram, TikTok) through The Thaiger, the following restrictions and best practices must be followed:

4.1 Restricted and Prohibited Content

  • Cannabis and Related Products: Ads for cannabis or cannabis-derived products are strictly prohibited under both Thai law and platform policies.
  • Alcohol: Alcohol-related ads are prohibited, including direct promotion or displaying alcohol products. Creative, organic content can be produced, but cannot be promoted as ads.
  • Medical Content: Sensitive or speculative medical content may be disapproved. Only FDA-approved products with verified claims are allowed to be promoted.
  • Other Prohibited Content: Content related to gambling, tobacco, sexually explicit material, or misleading claims is barred from promotion, consistent with both Thai law and platform-specific guidelines.

4.2 Best Practices for Approval

  • Compliance with Platform Guidelines: Ensure ads meet the advertising policies of Google Ads and Meta, as disapproved ads can lead to warnings or account restrictions.
  • Clear Disclaimers: Include disclaimers where necessary, especially for health and wellness products.
  • Pre-Approval by Editorial and Ads Team: Submit all ad content for review by The Thaiger’s editorial and ads team before uploading to ad platforms.
  • Focus on Organic Content: For restricted topics like alcohol or cannabis, rely on creative organic content instead of paid promotions.

5. Enforcement

  • Pre-Publication Review: All advertisements and commercial content must pass review by The Thaiger’s Editorial team before publication to ensure compliance with Thai laws and ethical standards.
  • Evidence and Documentation: For products or services requiring licenses/registration, advertisers must provide valid proof of such permits before approval.
  • False or Misleading Ads: If any ad is found to contain false, exaggerated, or misleading claims, The Thaiger reserves the right to immediately remove (take down) the advertisement without prior notice and may report serious offences to the relevant authorities.
  • Penalties and Liabilities: Advertisers should be aware that violations of Thai laws—such as the Consumer Protection Act, Food Act, Criminal Code, or Computer Crime Act—could result in legal action, including fines and/or imprisonment.

5. Legal References

  • Consumer Protection Act (B.E. 2522)
  • Food Act (B.E. 2522)
  • Thai Criminal Code, Sections 341, 343 (Fraud and related offences)
  • Computer Crime Act (B.E. 2550/2560), Section 14(1)
  • Laws governing alcohol, tobacco, and other regulated products

6. Amendments

  • These Guidelines may be updated or amended in line with any changes in Thai laws or as deemed necessary by The Thaiger. Any significant modifications will be communicated to advertisers in a timely manner.
