A 70 year old Thai rapist accused his 13 year old victim and her mother of faking a sexual assault case to extort money from him.

The victim’s mother sought help from the Investigation Division of Metropolitan Bureau (IDMB) after learning that her daughter was repeatedly raped by the 70 Thai man, Piw, over a five-year period since she was eight years old.

The mother told officers that Piw’s son was her boyfriend. She moved to live with him at Piw’s home in Ding Daeng district of Bangkok in 2018 when her daughter was eight years old. Four people lived in the house including the woman, the girl, her boyfriend, Piw, and his wife.

She and other family members heard someone crying at night for many years and thought it was a ghost. Her daughter revealed to her last year that the crying was her and she wanted to move out of the house.

The girl went on to say that Piw sexually assaulted her since she was eight. He lured her into a kitchen when her mother and stepfather were out and raped her. The girl said she felt hurt and scared but was afraid to scream because Piw threatened to kill her.

The girl said that Piw assaulted her repeatedly. She was afraid to tell anyone and chose to cry alone almost every night. The mother immediately left the house and reported the sexual assault to the police.

Victim blamed

Police issued a warrant for Piw’s arrest but he refused to surrender. Piw fled from his home and hid at the homes of his relatives and friends. He knew a lot of people because he was the leader of a famous Chinese lion dance troupe.

Officers searched for Piw for more than two weeks before they finally arrested him on April 5 at a house in the Bang Kapi district of Bangkok. Piw denied the charges and even accused the victim and her mother of faking the rape to get his money.

Piw claimed that he did not do anything wrong but said that he had to escape because he did not want to be arrested for something he had not done.

Piw accused the victim’s mother of using her daughter to get money. He said that the girl’s mother always lured men to get close to her daughter, faked a sexual assault and demanded money from the men and he was another victim.

However, officers were not convinced by Piw’s account and initially issued four charges against him including:

  • Section 277 of the Criminal Law: sexually assaulting a minor under 13 years old. The penalty is imprisonment from seven to 20 years and a fine from 140,000 to 400,000 baht, or life imprisonment.
  • Section 329 of the Criminal Law: taking away minors aged under 15 years old from parents or guardians for an indecent purpose. The penalty will be imprisonment from two to 10 years and a fine from 4,000 to 20,000 baht.
  • Section 377 of the Criminal Law: sexually assault minors aged under 15 years old, who were not a wife or husband, no matter whether the minors consent or not. The penalty will be imprisonment from five to 20 years and a fine from 100,000 to 400,000 baht.
  • Section 317 of the Criminal Law: taking children aged under 15 years old from their parents. The penalty will be imprisonment from three to 15 years and a fine from 6,000 to 30,000 baht.
