Purpose of Products and Services Offered and Limitation of Liability

TheThaiger.com is a website and application designed for reading news and lifestyle articles. It focuses mainly on news, events, products, and services in the Kingdom of Thailand. The Thaiger also operates a referral program for its products and services. Here, products and services of partner companies, referred to as “Service Providers”, are promoted on certain pages. Users can inquire about these services and products by submitting an “Inquiry”. This inquiry is then passed directly and solely to the Service Provider that provides the desired service.

Services Not Provided

The Thaiger does not have any service professionals employed within its cadre. Neither will it engage in conversations or provide advice pertaining to any products with either Users or Service Providers.

The Thaiger remains neutral and is not a participant in any potential transactions that occur between Users and Service Providers on its platform. All management of inquiries and delivery of relevant services lies solely in the hands of the individual Service Providers.

The Thaiger provides no guarantees regarding any Service Provider. It does not vouch for the accuracy or authenticity of the services claimed to be provided by any Service Provider.

Services Provided

The Thaiger serves as a comprehensive platform providing news and lifestyle content to users. Additionally, it doubles as a portal for users to access various services such as insurance, visa, legal and motoring from service providers in Thailand. This helpful service does not involve service provision but rather builds a bridge between users and service providers through its website. The selection process hinges on the user’s preferences and availability of service providers at any given time. Management and delivery of such services rest solely in the hands of the service providers, with The Thaiger playing no part in this role.

A significant aspect of The Thaiger’s work entails collecting information related to products and services offered by local service providers. This collation also includes data from numerous publicly accessible websites. The wealth of information is available to all users browsing the site and exists to aid with decision-making processes concerning preferred services and products. After settling on a decision, The Thaiger acts as the intermediary, facilitating contact between the user and the chosen service provider. This facilitation may involve forwarding user information to the service provider or vice versa.

However, users not intending to choose a service or product can simply use the website for browsing purposes. In such an event, only some provisions of these Terms of Use will be applicable to the use of the website. The remaining provisions become irrelevant and don’t affect the user-experience.

Data Protection

These Terms of Use encompass all electronic data or information, called “Data”. This includes personal data as defined by the Data Protection Acts of 1988 and 2003, and the EU General Data Protection Regulation GDPR 2018 (the “DP Acts”). This data is submitted by the User onto the Website and then forwarded by The Thaiger to the Service Provider. The processing of this data is necessary to finalize the contract between the User and the Service Provider.

To enable the services, The Thaiger requires to share the User’s personal information. This includes any given medical information to the chosen Service Providers. The User gives explicit consent to The Thaiger to disclose their personal details to the Service Providers. This applies even where the Service Providers are based in countries with less stringent data protections than the European Union. The Thaiger may also use contact details, such as phone number and email address, to update the User about the progress of a consultation with a Service Provider and other Thaiger services.

The Thaiger is committed to protecting the privacy of the User and others who access the website and use its facilities. To understand how The Thaiger uses cookies and collects and uses information, please read the Privacy Policy. This policy is incorporated into and forms part of these Terms of Use.

The User agrees to The Thaiger operating servers located outside of the European Union and the transfer of personal data outside the European Union. By using this website, Users give consent to The Thaiger to hold and process personal data about them. This process could be electronic or manual, and it’s done for the operation, management, security, and administration of The Thaiger and to comply with applicable laws and regulations.

Any communication between the User and Service Provider may be routed through TheThaiger.com. This includes emails or Instant Messenger, and the content may be retained by The Thaiger to assist Service Providers in tracking their communication. Likewise, phone communication between the User and Service Provider may be routed through The Thaiger. Details like time and date, success or failure, and telephone numbers may be stored. Additionally, an audio recording of the call may be made and stored. In such cases, the User will be informed in advance.

By signing up as a Registered User, Users agree to receive advertisements or promotional material via email from The Thaiger. Should Users not wish to be contacted for marketing purposes, they have the option to “unsubscribe” from email communications or contact The Thaiger directly at info@thethaiger.com.

Provision of Information

If a user desires to schedule a consultation with a service provider, they are required to supply specific details. These include contact information (telephone number and email address), age, gender, and certain product details. The Thaiger uses this information to connect the user with appropriate service providers. It is the user’s responsibility to ensure that the information provided is current, precise in all key aspects, does not infringe on others’ confidentiality or third-party rights, and is sufficient for The Thaiger to proceed. However, despite The Thaiger’s commitment to privacy, users should refrain from providing any information that could potentially harm them if disclosed.

Transmitting information across the Internet can never be entirely secure due to the risk of interception, loss, or alteration. Users must understand and accept the security risk associated with providing any information via the website. The Thaiger disclaims any responsibility for information transmitted over the Internet. Consequently, The Thaiger will not be held accountable for any damage or loss incurred related to any information sent by the user to The Thaiger or a service provider, or any information sent by The Thaiger, a service provider, or any third party to the user via the Internet.

Suspension/Termination

At any given time, The Thaiger reserves the right to suspend or halt a User’s access to the website, or any of its services, either in full or in part. This could be for a range of reasons, including if the User has provided incorrect or deceptive information, or has violated these Terms of Use, or if The Thaiger is unable to validate any information provided to the website by the user. The Thaiger holds no liability for any suspension or discontinuation of a User’s access to the website towards the User or a third party.

Intellectual Property

This site’s content is safeguarded by numerous international copyright, patent, and trademark laws, along with intellectual property laws and global treaties. The Thaiger explicitly prohibits copying, reproducing, publishing, or broadcasting any protected content found on this site without written consent. All trademarks displayed on this site are possession of their respective owners, and the User is not permitted to use them in any manner.
