Simpson's lawyer argues no-contact order should be modified for children visits

Brad Simpson’s attorney has filed a motion seeking permission for him to see his four children while in custody. Stephen Gilmore, his court-appointed lawyer, submitted the request to Bexar County Court No. 7 on Monday. Gilmore contended that Simpson, 53, should be allowed contact with his children as they play no role in the charges against him and he does not pose a flight risk.

The motion stated that the children are not involved in any legal cases nor has the state provided evidence linking their interaction to community safety or the safety of any alleged victims. Gilmore requested the modification of the no-contact order to permit “no harmful or injurious contact.”

Simpson has been detained since his arrest on 9 October, and the current detention conditions prohibit contact with his children, aged 20, 18, 15, and 5.

Initially, Simpson faced charges of assault on a family member causing bodily injury, unlawful restraint, and possession of a prohibited weapon. He was later charged with tampering/fabricating physical evidence on Wednesday. His bail is set at $3 million.

The additional charges arose after Simpson allegedly instructed his business associate, James Valle Cotter, 65, to conceal a firearm. Cotter reportedly agreed to hide an AK-47 in his San Antonio home, embedding it within a wall. A K-9 team from the Bureau of Alcohol, Tobacco, Firearms and Explosives located the weapon on Monday.

Cotter was arrested the same day for allegedly hiding the gun and tampering with evidence, as well as not being forthcoming with law enforcement. His bail has been set at $500,000.

Suzanne Simpson has been missing since 6 October following a reported altercation with her husband of 22 years in Olmos Park, San Antonio. Olmos Park Police Chief Fidel Villegas noted a “disturbance” between the couple at the Argyle, a local club, during a previous news conference.

The neighbour observed Suzanne trying to escape from Brad’s grasp. About an hour later, the neighbour saw Brad’s black GMC pickup truck leaving and returning within a couple of hours.
